GENERALITIES & APPLICATION OF THE GENERAL TERMS AND CONDITIONS OF SALE (GTC)

Confirmation of the order implies full acceptance of the GTC by the customer.

In the absence of any other written agreement between the seller and the customer, these GTC shall prevail. With the exception of specific cases, this document does not require a handwritten signature to conclude a sale, confirmation of the order by the customer is deemed to be an approval of the contents of the GTC.

In the event of a change to the GTC, the conditions that apply shall be those outlined on the website at the time the order was placed.

These GTC are governed by and subject to the application of Swiss law.

The products on the T&P Group Sàrl website are listed for sale in Switzerland.

The photos and illustrations are not contractual. The details and explanations given are for information purposes only. They are not a contractual document.

Our offers are exclusively reserved for customers who have attained the age of majority and are capable of discernment (that is, not under guardianship or curatorship).

In accordance with Article 13681 of the Swiss Penal Code, the sale of spirits, aperitifs and alcopops in quantities likely to endanger health is prohibited to persons under the age of eighteen (18 years old). The sale of wines, ciders and beers is prohibited to persons under the age of sixteen (16 years old). The buyer undertakes to certify that they have attained the legal minimum age required.

Alcohol abuse is dangerous to health. Drink and enjoy in moderation.

VALIDATION OF THE ORDER

The orders are not definitive and are not prepared until receipt of payment and the full contact details of the buyer and the recipient of the order. Preparation of the order is subject to receipt of all these elements. If these elements are missing, T&P Group Sàrl shall not be held responsible for any delays in delivery.

Payments by bank card are secure. T&P Group Sàrl does not store any of the banking data communicated during online purchases.

For the delivery to be made, the full amount for the order must be paid upon validation of the order.

T&P Group Sàrl reserves the right to refuse to fulfil an order for a customer with whom an ongoing dispute has not been resolved.

PRICE:

All prices are displayed in Swiss francs, include VAT, and do not include delivery fees.

The prices displayed at the time  of the order are subject to changes in the assortment, vintage, availability of items and the correction of obvious errors or typos.

T&P Group Sàrl can run promotions on its assortment. These offers are valid only for the period during which it is published on the site and cannot be requested retroactively.

The prices displayed in currencies other than Swiss francs are for information purposes only and does not constitute an offer by T&P Group Sàrl, nor does it constitute a commitment in terms of an exchange rate. All the wines listed for sale are subject to availability and market changes.

SHIPMENT OF YOUR ORDER

Orders are generally shipped within a period of two (2) to three (3) days of receipt of payment. Shipments are made either via our courier service or a third party. Each shipment will be assigned a tracking number.

No deliveries shall be made on Saturdays, Sundays, nor on national or cantonal bank holidays.

T&P Group Sàrl cannot be held liable for any problems in delivery in the event of a mistake or incomplete information in the purchase order. If the goods were returned due to an erroneous or incomplete address, the customer can either choose a new shipment for which they shall bear the full cost or a refund of the order after deduction of the shipping fees.

Shipping fees include processing and packaging as well as delivery fees. Processing fees are fixed, while delivery fees will vary according to the full weight of the package. We recommend that you combine all your items into a single order. We will not be able to combine two orders that were placed separately and consequently shipping fees will be applied to each one.

Goods travel at the risk of the buyer. T&P Group Sàrl cannot be held liable for any defect from the postal or transport service.

Deliveries are only carried out in Switzerland. The delivery will be made to the delivery address indicated by the customer.

DELIVERY TIME

Orders are generally shipped within a period of two (2) to three (3) days of receipt of payment. We may need to verify your information with your card issuer before shipping your order. We will do our best to reduce this time period. The delivery time is calculated from the time your order has been accepted and payment has been received. This time includes a 24-hour period during opening days, except in case of Force Majeur, in which your items are processed and shipped from our warehouse. You will be notified of a separate delivery time for items that are not in stock. We will work closely with our delivery partner to reduce delivery times as much as possible. You should expect to receive your items within five (5) to six (6) working days provided that they are in stock.

No deliveries shall be made on Saturdays, Sundays, nor on national or cantonal bank holidays.

If the address given was incorrect, the buyer is solely responsible for the consequences (delivery delays, extra cost of delivery).

SHIPPING FEES

Delivery fees are not invoiced for e-commerce orders from JAYA or T&P Group Sàrl.

SHIPPING LEGISLATION

Orders are subject to current Swiss legislation.

Users who order via the Jaya Prosecco or T&P Group Sàrl website undertake to comply with Article 13681 of the Swiss Penal Code relative to the sale of alcohol which specifies that the sale of spirits, aperitifs and alcopops is prohibited to persons under the age of eighteen (18 years old) and that the sale of wines, ciders and beers is prohibited to persons under the age of sixteen (16 years old). Buyers, therefore, attest to having attained the age required to make the order and that they are not under guardianship or curatorship.

For any order destined for a country other than Switzerland, the customer should contact T&P Group Sàrl for more information regarding the possibility of international delivery.

T&P Group Sàrl has a right of withdrawal if the order is destined for a country in which the law prohibits the import of alcohols or wines.

Orders for export are subject to the legislation of the recipient country.

QUALITY, DEFECT AND NOTIFICATION OF DEFECT

T&P Group Sàrl makes every effort to ensure that the wines in its possession are preserved and stored in proper conditions, but shall not be held responsible for the state, and condition of the wines, nor for the quality expected based on the description. According to the provisions of the Association Suisse du Commerce du Vin (Swiss Association for the Sale of Wines), defective bottles shall only be replaced if the Swiss or foreign wines were bottled in Switzerland, and up to one year after its purchase. No replacement or refund shall be made for foreign wines bottled in the manufacturing country or elsewhere. T&P Group Sàrl must be notified of any defect or irregularity within a maximum of 8 days after the collection or receipt of the good.

DISPUTES, APPLICABLE LAW AND JURISDICTION

In the event of a dispute, the buyer should first contact T&P Group Sàrl Cellar to reach an amicable solution. These terms and conditions of sale are subject to Swiss law. Any dispute relative to a sale concluded within the parameters of these general terms and conditions of sales shall be under the exclusive jurisdiction of the courts of the canton of Vaud, and subject to possible appeal in the Federal Court.
